Commodities exchange KalshiEx may resume offering derivative contracts that allow Americans to place money on which political party they believe will gain control of Congress after the November elections, the U.S. Court of Appeals for the D.C. Circuit ruled Wednesday.

The appeals court rejected the Commodity Futures Trading Commission's bid to stop KalshiEx from offering its "Congressional Control Contracts." The three-judge panel said the federal agency failed to show the contracts would incentivize political misinformation or have other negative consequences on the election.
