The U.S. Supreme Court on Monday turned away an appeal from a Texas homeowner whose property was damaged during a police stand-off with a kidnapper who had used the home to hide from law enforcement.

The denial comes as a defeat for petitioner Vicki Baker, whose $60,000 jury verdict was overturned by the U.S. Court of Appeals for the Fifth Circuit. Baker, represented by the civil liberties group Institute for Justice, had asked the justices to review the appeals court's decision holding that plaintiffs have no constitutional takings claim against the government for police property damage that was "objectively necessary."
