The U.S. Court of Appeals for the Third Circuit on Friday upheld a National Labor Relations Board order requiring Starbucks to rehire workers terminated after they engaged in labor organizing but struck down certain monetary remedies granted under a new board doctrine.

The Third Circuit's decision requires the coffee shop giant to reinstate and give backpay to Philadelphia baristas Echo Nowakowska and Tristan Bussiere who were fired allegedly due to their union support in 2020. But the judges said Starbucks couldn’t be forced to compensate them for certain “direct or foreseeable pecuniary harms” resulting from unfair labor practices.
