The U.S. Department of Justice has filed an emergency appeal with the Supreme Court to reinstate a law requiring businesses to disclose their owners to the federal government, arguing the statute enjoys a “presumption of constitutionality” and that a lower court wrongfully rejected DOJ's Commerce Clause defense.

U.S. Solicitor General Elizabeth Prelogar penned the urgent request to the justices on Dec. 31, asking them to lift a Texas federal judge’s nationwide blockade of new federal reporting requirements for companies registered to do business in their states.
