Just ahead of a scheduled oral argument in a federal appeals court Monday, streaming service FuboTV ended an antitrust lawsuit against The Walt Disney Co., FOX Corp. and Warner Bros. Discovery after the parties reached a surprise settlement.
“Quite literally, while I was on the courthouse steps, literally, we’ve reached a deal,” Cravath, Swaine & Moore partner J. Wesley Earnhardt, who represented Disney, told a U.S. Court of Appeals for the Second Circuit panel on Monday. “We have agreed not to argue because we have a deal.”
