A divided U.S. Court of Appeals for the Ninth Circuit on Monday held that federal law allows multiple indigent prisoners to join in a lawsuit as long as they each pay the filing fee.
The panel said the Prisoners Litigation Reform Act, which requires prisoners to each pay the full filing fee to file a complaint, could not prevent three men incarcerated at a California prison from bringing a joint lawsuit “in forma pauperis.”
