An Am Law 100 firm representing former Baltimore City State's Attorney Marilyn J. Mosby argued that trial court errors require the U.S. Court of Appeals for the Fourth Circuit to toss out Mosby’s white-collar criminal convictions.

“The district court reversibly erred by admitting evidence of how Ms. Mosby used the money that she withdrew from her retirement account,” Wilmer Cutler Pickering Hale and Dorr partner Daniel Volchok told a three-judge Fourth Circuit panel this past Friday. “That evidence was inadmissible because it was irrelevant.”

U.S. District Judge Lydia K. Griggsby also provided “erroneous” jury instructions in the trial that convicted Mosby of mortgage fraud, Volchok argued. “I ask the court to set aside the convictions and the forfeiture order.”
