Doctor 'issued' fatal prescription

A sharply divided Georgia Supreme Court has upheld a trial court's refusal to dismiss a 33-count felony indictment against a physician for unlawfully distributing or dispensing a controlled substance. The constitutional controversy is over whether the doctor's conduct was even a crime. The alleged crime: He gave his nurse practitioner a pad of signed prescription slips when he went on vacation.
