It might seem like Judge Emmet Sullivan of the federal district court in Washington is a broken record, complaining often about prosecutors failing to turn over favorable material to defense lawyers.

At a hearing on June 22, Sullivan questioned whether Justice Department Criminal Division trial attorneys were slow to produce key witness information in a high-profile drug trafficking conspiracy. Justice lawyers, citing “evidentiary concerns,” among other reasons, are moving to dismiss the case against businessman Zhenli Ye Gon. Justice prosecutors reject the criticism. Ye Gon, who faces charges in Mexico, has been jailed since his arrest in July 2007.
