As the economic downturn continues to run its course, many law firms are hesitating to bring new blood into their partnerships. Instead, they are establishing and hiring for various counsel positions. In myriad conversations with managing partners and other law firm leaders, it has become clear that, as these counsel positions become more widespread so, too, does the confusion surrounding exactly what those titles mean — i.e., what is expected by the law firms and of the individual lawyers hired into these roles. Before we head too much further down this path, it is imperative for firms to carefully define each position in their portfolio: of counsel, counsel, special counsel, senior counsel, international counsel and any other “counsel” positions they choose to establish.
