Claims on food labels can be likened to sound bites, meant to attract and inform the consumer with news about positive nutritional characteristics or potential health benefits. People benefit from information that is truthful, meaningful and easily digestible. At the same time, the U.S. Food and Drug Administration (FDA) must work closely with industry to ensure that these quick bites do not unduly deceive consumers into thinking a particular food is something it’s not.

Lately, regulators have been giving food labeling claims heightened scrutiny and increasing their enforcement efforts. While challenges are necessary to ensure that food producers do not make false or misleading claims, misguided challenges can chill the delivery of useful information and threaten free speech.
