A $33 million malpractice case against Dickinson Wright of Detroit can move forward in federal court, according to a recent ruling by the U.S. Court of Appeals for the Federal Circuit.
The court’s Jan. 11 unanimous panel ruling in Warrior Sports Inc. v. Dickinson Wright vacated an Eastern District of Michigan dismissal order. The lower court had ruled that the case raised only state law issues and that the court therefore lacked jurisdiction. But the Federal Circuit ruled that the case belongs in federal court because “at least one of Warrior’s malpractice claims requires the court to resolve a substantive issue of patent law.”
