EOG Resources Inc. v. Hurt

Standard Investment Co. entered into an oil and gas lease with EOG Resources. James Hurt leased land from SIC for ranching. Hurt sued EOG after losing cattle on the property allegedly due to a damaged fence, alleging he was a third-party beneficiary of the the oil and gas lease. A jury awarded damages and attorneys' fees to Hurt. Third-party beneficiary claims succeed or fail according to the provisions of the contract upon which suit is brought. The trial court's judgment is reversed and rendered. Fort Worth Court of Appeals, No. 02-11-00093-CV, 12-15-2011.
