United States v. Lundy

The appellant was convicted of the use of facilities of interstate commerce to attempt to persuade, induce and entice a minor female to engage in illegal sexual activity. Sufficient evidence to prove attempt must show that the defendant acted with the kind of culpability otherwise required for the commission of the underlying substantive offense, and that the defendant had engaged in conduct that constitutes a substantial step toward commission of the crime. The conviction is affirmed.5th U.S. Circuit Court of Appeals, No. 10-60986, 03-28-2012.
