IN THE TENTH COURT OF APPEALS

ABATEMENT ORDER

Glenelius Shimon See was convicted of assault and sentenced to one year in jail. His sentence was suspended and he was placed on community supervision for one year. See was represented by appointed counsel at trial. However, he filed a notice of appeal without the benefit of counsel. The Clerk of this Court notified counsel by letter that according to the Courts records, counsel remained appointed and that a certificate of defendant’s right of appeal was not contained in the clerk’s record on appeal. We received a supplemental clerk’s record containing a certificate of defendant’s right of appeal and a motion to withdraw prepared by counsel filed in the trial court. Further, the clerk’s record contained an order by the trial court granting counsel’s motion to withdraw. New counsel to represent See on appeal was not appointed.
