We are more than a decade into the explosion in stockholder litigation challenging merger transactions, and the trend shows no sign of abating. Whereas in 2000, less than 20 percent of announced public company mergers were challenged in court, Cornerstone Research data shows that last year about 95 percent of such deals drew shareholder challenges.

Nowadays, every deal gets its day in court. And usually more than one day, in more than one court.
