A group that advocates for atheists wants a federal appeals court to overturn a federal judge’s decision last year that allowed the U.S. government to keep a six-foot statue of Christ on federal land near the Whitefish Mountain Resort in Montana.

The nonprofit Freedom From Religion Foundation filed its opening brief in the U.S. Court of Appeals for the Ninth Circuit on Jan. 28, the Associated Press reported. The group is fighting a ruling last June from Chief Judge Dana Christensen of U.S. District Court for the District of Montana. Read the Ninth Circuit brief here.
