A federal court of appeals has ruled a district court illegally sentenced two Oregon men to less time than the statutory minimum of five years for setting fires on their ranch that spread to government lands.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit on Feb. 7 ruled that U.S. District Judge Michael Hogan of Oregon did not have the discretion to sentence Dwight Hammond Jr. to three months in prison and his son, Steven D. Hammond, to one year and one day. The appellate court’s ruling is here.
