Eli Lilly and Co. has filed arguments opposing imposition of sanctions over allegedly perjurious testimony by a witness in an Actos bellwether trial pending in Louisiana federal court.

The plaintiff has called for default judgment as a sanction against the company. Eli Lilly responded, however, that the plaintiff’s counsel have not cited a single case in which a court used its inherent authority to enter a default judgment against a defendant for any reason.
