A federal appeals court has ruled that Katrina insurance lawsuits severed from a class action against American National Property and Casualty Co. (ANPAC) belong in federal court, not state court.
A three-judge panel of the U.S. Court of Appeals for the Fifth Circuit on March 26 ruled that there is federal jurisdiction over these individual cases that were once part of a Class Action Fairness Act (CAFA) case. The ruling is a victory for ANPAC.
