A federal magistrate has denied a motion by a California fruit grower to dismiss a putative class action by farmworkers alleging they have not been fully paid for their work and have been cheated out of 10-minute rest breaks.

Laborers Rafael Marquez Amaro and Jesus Alarcon Urzua, two of thousands of grape and tree fruit pickers who have seasonally worked for Gerawan Farming Inc., accuse the grower of violating federal and state laws governing wages and working hours.
