A federal district court in California jumped the gun in a putative class action brought by former San Francisco police officers by effectively addressing the merits of the case before concluding whether it met the standards for class certification, a panel of the U.S. Court of Appeals for the Ninth Circuit has ruled.
The three-judge panel on April 24 labeled the denial of certification by U.S. District Judge Phyllis Hamilton an abuse of discretion, and reversed her ruling and remanded the case, Stockwell v. San Francisco.
