Failing to tell truck driver applicants they had the right to see and contest their background checks will cost Swift Transportation Co. $4.4 million, under the terms of a class action settlement agreement newly filed in federal court in Virginia.
The nationwide trucking firm on April 22 approved the agreement, which could mean $50 for each of about 10,000 job applicants, but emphasized that it denied all charges of wrongdoing or liability. Swift said it signed on to avoid the likely cost of additional litigation in Ellis v. Swift Transportation Co. of Arizona LLC.
