A milk company is renewing its argument that a plaintiffs’ expert went “back to the drawing board” in a consumer protection class action, revising his expert opinion after he gave his deposition testimony.

Milk company Horizon has moved to strike or exclude the testimony of expert Richard Bazinet. The litigation involved claims that Horizon made fraudulent claims about the value to consumers’ brain health from drinking Horizon organic milk enriched with DHA Omega-3 fatty acids.
