Class action plaintiffs are asking for reconsideration of a federal magistrate judge’s decision to exclude an expert witness in lawsuits that allege Horizon organic milk falsely advertised it supports brain health.
U.S. Magistrate Judge John J. O’Sullivan of the Southern District of Florida granted WhiteWaves Foods Company’ motion to strike or exclude the testimony of Richard P. Bazinet, an expert in nutritional neuroscience and the plaintiffs’ general causation witness.
