The plaintiffs in a proposed class action against a rehabilitation program allegedly affiliated with scientology say a federal judge abused his discretion by not allowing them to file an amended complaint before he dismissed their case with prejudice.

In their appeal, Benjamin Burgess and six other named plaintiffs in Burgess v. Religious Technology Center protest that U.S. District Court Judge Steve Jones of the Northern District of Georgia turned down their request to amend their complaint because they included it in their response to the defendants’ motion to dismiss rather than in a separate motion.
