A medical device manufacturer that is defending against 20,000 cases in federal multidistrict litigation argues that transvaginal mesh taken out of the bodies of women alleging injury from those devices should be preserved for all plaintiffs, not just in bellwether cases.

“All defendants seek is an order requiring that preservation occur for all cases pending against them in MDL 2327, and that ultimately, once cases are selected for trial preparation, that defendants be given equal access to the evidence,” defendant Ethicon Inc. said in a court filing this week.
