A federal judge should not unwind the decision to exclude the plaintiffs’ expert in several consumer protection class actions over the neurological benefits of milk enriched with an omega-3 fatty acid, a milk producer is arguing in federal court.

U.S. Magistrate Judge John J. O’Sullivan of the Southern District of Florida ruled that Richard P. Bazinet should be excluded, among other reasons, because the expert could not extrapolate the results of five randomized controlled trials in 49 healthy women and 658 healthy children to every consumer in six states that purchased the dairy products.
