A Zipcar Inc. customer in California has slapped the car-sharing service with a class action, claiming the late fees it charges rental customers constitute unlawful penalties that “are unconscionable, void and unenforceable” under state laws.
Plaintiff Gabriela Bayol challenged Zipcar’s imposition of late fees in a complaint filed May 29 in the U.S. District Court for the Northern District of California, arguing she and proposed class members are entitled to restitution of those fees that range from $50 for returning a car one minute late up to a maximum of $150.
