A Tennessee federal judge has balked at approving the settlement of a proposed class action over factory pay practices because details of the deal were confidential, ruling that there is a public interest in the transparency of Fair Labor Standards Act litigation.

U.S. District Judge Jon McCalla of the Western District of Tennessee said in a June 13 opinion that keeping secret the terms of the putative settlement between plant workers and Unilever Manufacturing (U.S.), Inc., contradicts a key purpose of the law: To advance workers’ knowledge of their FSLA rights.
