The New York Court of Appeals has reversed a $10 million plaintiffs verdict against Volvo Cars of North America because the jury was given a malpractice-oriented instruction in a trial over a defective product design.
The trial court told the jury that a manufacturer such as Volvo, with special training and experience in designing automobiles, is required to use the same degree of skill and care that others in the field would reasonably use in the same situation.
