Plaintiffs lawyers in consumer-protection class actions challenging nutritional claims made for a brand of milk are appealing a federal magistrate judge’s exclusion of their sole expert.
The magistrate rejected expert on the ground that he could not extrapolate his opinion to all consumers in the United States, but the plaintiffs maintain that he needed no such extrapolation to render his opinion admissible.
