A Wendy’s Old Fashioned Hamburgers affiliate has been targeted with a proposed class action that claims its Pittsburgh-area restaurants violate the Americans with Disabilities Act because of architectural barriers that limit access for wheelchair users.

Pennsylvania resident Christopher Mielo, who relies on a wheelchair for mobility, filed the lawsuit on July 9 in the U.S. District Court for the Western District of Pennsylvania, alleging that noncompliance by Wendy’s Old Fashioned Hamburgers of New York with the ADA “significantly impeded” his access to the fast-food chain’s restaurant in Monroe, Pa., which he visited in June 2014.
