A group of Virginia plaintiffs objecting to a national class action settlement over the fuel efficiency of Hyundai and Kia vehicles argue they will be deprived of due process rights if they are forced into the settlement.

The proposed national settlement with Hyundai Motor America and Kia Motors America Inc. would resolve litigation over the advertised fuel efficiency of their vehicles.
Plaintiffs’ counsel James B. Feinman and Andrew D. Finnicum, of James B. Feinman & Associates in Lynchburg, Va., said that, if their particular class action is dismissed without being certified, their clients will not be allowed to opt out of the settlement and proceed without facing a statute of limitations defense.
