The Delaware Supreme Court has ordered a new asbestos trial for the manufacturer of industrial talc because the trial judge did not instruct the jury about a codefendant’s duty of care to the plaintiff.
R.T. Vanderbilt Co. Inc., which supplied industrial talc until the late 1970s to a BorgWarner Inc. bathroom fixtures facility at which the plaintiff was employed, argued that the jury should have been instructed about the liability the plaintiff’s employer could have for failing to protect employees from exposure to asbestos.
