A Florida federal judge has refused to dismiss a proposed class action that accuses Chattanooga-based Chattem Inc. of falsely claiming its ACT mouthwash rebuilds tooth enamel. At the same time, however, the judge reduced the number of claims against the company.

Judge Roy Dalton Jr. of the U.S. District Court in Orlando ruled July 24 to grant in part and deny in part a motion by Chattem, a consumer health care products company, to dismiss the class action complaint brought by consumer and plaintiff Lauren Foster.
