The Texas Supreme Court has ruled there was insufficient proof that a man’s asbestos exposure as a youth caused him to develop and die from mesothelioma.
The 6-3 ruling by the court affirmed the lower appeals court’s decision to overturn a $12.3 million jury verdict against Georgia-Pacific Corp., holding that the family members of Timothy Bostic had not shown that Georgia-Pacific’s asbestos-containing products were a “substantial factor” in causing him to die from mesothelioma at age 40 in 2003.
