Two claims involving ear treatment products sold by Walgreen Co. Inc., will remain joined in a proposed class action filed by California consumers who allege the retailer is falsely advertising the products, according to a ruling by a California federal judge.
U.S. District Judge Barry Moskowitz of the Northern District of California on July 24 denied Walgreen’s motion to sever plaintiffs’ claims involving Walgreen’s homeopathic Ear Pain Relief and Ear Ache Drops, ruling against the company’s argument that the products are made by different manufacturers.
