Two classes with more than 900,000 potential members who allege that Caribbean Cruise Line Inc. violated federal law by launching robocalls using a “free cruise” ruse have been certified by an Illinois federal judge.
U.S. District Judge Matthew Kennelly of the Northern District of Illinois gave the go-ahead on Aug. 11 for Birchmeier v. Caribbean Cruise Line to proceed, finding the plaintiffs can sufficiently identify individual calls received by class members with landlines or those with mobile phones by records kept by the cruise line, its affiliates and third-party carriers.
