Two radiologists who used image-guided injection to administer steroids tainted with fungus to at least 30 plaintiffs argue that they would only be liable if the plaintiffs sought to bring medical malpractice lawsuits against them.
Federal multidistrict litigation, pending over the tainted steroid methylprednisolone acetate compounded by the now-shuttered New England Compounding Center, is proceeding in Massachusetts federal court. The now-bankrupt compounding pharmacy produced an injectable steroid that became infected with fungus and led to a fatal breakout of meningitis.
