In a case of first impression, the U.S. Court of Appeals for the Sixth Circuit has ruled that a former federal mine inspector does not qualify for Black Lung Benefits Act assistance.
U.S. District Judge Walter Rice, sitting by designation, wrote the opinion. An administrative judge had awarded Terry Forester benefits because he worked for five years for a private coal mining company and for 16 years as an inspector for the U.S Department of Labor’s Mine Safety and Health Administration.
