The U.S. Court of Appeals for the Eleventh Circuit has ruled that survivors of miners who died from black lung disease can get survivors benefits under the Patient Protection and Affordable Care Act even if they previously were denied such benefits.
Johnny Davis was awarded lifetime benefits under the federal Black Lung Benefits Act. His wife, Viola Davis, was not able to get the same benefits because she could not prove that the malady, also called pneumoconiosis, was a “substantially contributing cause or factor” leading to her husband’s death in 1993.
