The judge considering whether to grant a new trial after a jury returned a $9 billion verdict in the first federal Actos bellwether trial recently had several questions for the lawyers.

A jury awarded $9 billion, most of it in punitive damages, against Takeda Pharmaceuticals North America and Eli Lilly & Co in a case in which plaintiffs said they were not warned that using the diabetes drug increases their risk of bladder cancer. Lilly had an agreement to co-market the drug with Takeda.
