Tossing the case like a hot potato because of its intersection with religion, a Minnesota state judge has dismissed a putative class action alleging that Hebrew National’s hot dogs are not wholly kosher.

Dakota County District Court Judge Jerome Abrams declined on Oct. 6 to be the “higher authority” deciding whether the company misrepresents its frankfurters’ contents, as plaintiffs in Wallace v. Conagra Foods contend. Abrams said such a decision would be far outside the court’s jurisdiction because it involves a fundamentally religious question.
