California’s Garcia, Artigliere & Medby, which specializes in elder abuse litigation, filed two class actions last week against the owners of skilled nursing facilities.
In a nationwide class action filed on Oct. 8, the Long Beach, Calif., firm alleges that Harvest Management Sub LLC, which does business as Holiday Retirement, misclassified its executive chefs as exempt from overtime. The case was filed in U.S. District Court for the Northern District of California by a chef at the Bay Park facility in Pinole, Calif., who worked more than 40 hours per week during her nearly 10 years at the company, which operates 300 facilities across the country. The complaint makes claims under California wage laws and the U.S. Fair Labor Standards Act.
