A California federal judge has refused to dismiss all claims against Total Sweeteners Inc., a molasses seller being sued by American Licorice Co. over 1.5 million pounds of allegedly lead-contaminated syrup.
Judge Edward Chen of the U.S. District Court for the Northern District of California granted partial summary judgment to Total Sweeteners, agreeing with its argument that terms of the original sales contract, not a purchase order, govern the company’s dispute with American Licorice.
