A retired Army staff sergeant is battling $8,400 in sanctions a federal magistrate imposed against him for not appearing for a settlement conference in his product liability case against Burger King.

Wounded Iraq war veteran Clark Bartholomew had sued the fast-food chain, hamburger patty supplier CTI Foods Holding Co. and the Army and Air Force Exchange Service after he ingested what he said were sharp objects embedded in his Triple Whopper. His attorneys filed an objection on Oct. 30 to Magistrate Judge Richard Puglisi’s imposition of the compensatory sanctions, and requested that Puglisi’s finding be vacated.
