The immediate future for litigation over a chemical spill into a West Virginia river rests in the hands of a bankruptcy judge after U.S. District Judge John Copenhaver Jr. said he would stay a fight over whether the lawsuits should proceed in state or federal court.
Two defendants face at least 60 lawsuits over a chemical spill into the Elk River. Freedom Industries Inc., which makes a chemical used in cleaning coal, filed for bankruptcy after the chemical leaked from its terminal into the river in January. West-Virginia-American Water Co., the local water supplier, faces lawsuits, as well.
