A New York federal judge has refused to dismiss a proposed class action alleging Northwestern Mutual Life Insurance Co. engaged in alienage discrimination when it rejected a Mexican-born accounting major for a job even though he is legally allowed to work in the United States.

U.S. District Judge Katherine Forrest of the Southern District of New York found no favor with the insurer’s contentions that Ruben Juarez failed to either state a claim or to sufficiently allege the company intentionally and purposely discriminated against the Fordham University master’s degree candidate because he was neither a U.S. citizen nor a legal permanent resident.
