A New York federal judge has rejected Sirius XM Radio's motion for summary judgment in a class action lawsuit, finding members of the 1960s band the Turtles have exclusive performing rights to their recordings under New York State law.
Judge Colleen McMahon of the U.S. District Court for the Southern District of New York in Manhattan said in a 40-page order that defendant Sirius reproduced Turtles recordings without authorization by not obtaining licenses or paying royalties for using pre-1972 recordings.
